Terms of Service

These Terms and Conditions govern your use of the Sessionly website and app. By accessing or using Sessionly, you agree to these Terms.
1. About us
Sessionly is operated by Mark Devereux trading as Sessionly of PO Box, Poole, Dorset, BH15.

2. The service
Sessionly is a software platform designed for individual therapists and small agencies in the UK. The service may include, without limitation:
- client notes management
- waiting list management
- assessment tracking
- outcome measures
- invoicing support
- diary management
- enquiry tracking
- administrative controls
- other related practice management features made available from time to time
Sessionly is a business tool. It is not a crisis service, emergency service, healthcare provider, medical advice service, or substitute for professional legal, financial, medical or clinical judgment.
3. Eligibility
You may only use Sessionly if:
- you are at least 18 years old
- you are using the service for lawful professional or business purposes
- the information you provide is accurate and kept up to date
- you have authority to enter into these Terms on behalf of yourself or, where applicable, the organisation you represent
4. Account registration and security
You are responsible for:
- keeping your login credentials confidential
- restricting access to your account and devices
- all activity carried out under your account, unless caused by our breach
- ensuring that only authorised personnel access agency accounts
You must notify Sessionly promptly at hello@sessionly.uk if you suspect unauthorised use of your account or any security issue.
Sessionly may offer optional two-factor authentication. You are responsible for enabling and maintaining any security features available to you where appropriate.
5. Customer responsibilities
You are responsible for:
- ensuring that your use of Sessionly complies with applicable law, regulation and professional obligations
- ensuring you have an appropriate lawful basis for the personal data you upload or enter into the service
- ensuring the information you input is accurate and appropriate for your intended use
- maintaining your own records and exports where needed
- reviewing outputs, reports, automations or AI-assisted content before relying on them
If you are a therapist, practice or agency, you remain responsible for your own clinical, operational and legal decisions.
6. Acceptable use
You must not:
- use Sessionly for any unlawful, fraudulent or harmful purpose
- upload, enter or transmit content that you do not have the right to use
- use Sessionly to infringe confidentiality, privacy, copyright, database rights or other legal rights
- attempt to gain unauthorised access to any system, account, infrastructure or data
- probe, scan, reverse engineer, decompile, scrape, copy, mirror or interfere with the platform except where the law expressly permits and cannot be excluded
- introduce malware, harmful code, or any material intended to disrupt the service
- use the service to send spam or abusive communications
- share login credentials inappropriately
- use Sessionly in a way that could damage, disable or overburden the service
Sessionly may suspend or terminate access where it reasonably believes these Terms have been breached.
7. Trials, subscriptions and billing
Free trial: Sessionly may offer a 14-day free trial. At the end of the trial, continued use may require a paid subscription.
Paid plans: Paid subscriptions may be offered on a monthly or annual basis. Pricing, billing intervals and included features will be shown at the point of purchase or sign-up.
Payment processing:Payments are processed by Stripe. By making a payment, you agree to Stripe's applicable terms and privacy practices.
8. Renewals, cancellation and refunds
Monthly plans: Monthly subscriptions renew automatically unless cancelled before the next renewal date. If you cancel a monthly subscription, it will not renew, and you will usually retain access until the end of the current paid period.
Annual plans: Annual subscriptions renew on the basis presented at the point of purchase unless cancelled in advance of renewal. If you cancel an annual subscription, access will usually continue until the end of the current annual term.
Refunds: You may request a refund within 14 days of payment. After that, monthly plans are generally non-refundable for the current billing period but can be cancelled so they do not renew. Annual plans are generally non-refundable once the 14-day refund window has passed, and access continues until the end of the paid 12-month term.
Nothing in these Terms affects any non-excludable rights you may have under applicable consumer law.
9. Changes to pricing or service
Sessionly may change pricing, features, functionality, or parts of the service from time to time. Where a change materially affects your subscription, reasonable notice will be given where practicable. Sessionly may also add, remove, suspend or update features, including beta or experimental features.
10. Availability and support
Sessionly aims to provide a reliable service, but does not guarantee uninterrupted or error-free availability. There is currently no formal SLA. Support requests may be sent to hello@sessionly.uk, and Sessionly will aim to respond as soon as reasonably possible. Sessionly may suspend access temporarily for maintenance, updates, security, operational reasons, or circumstances outside reasonable control.
11. AI-assisted features
Where Sessionly includes AI-assisted functionality, including functionality supported by third-party models or services, such features are provided to assist users and may produce incomplete, inaccurate or unsuitable output. You are responsible for checking and deciding whether to rely on any AI-generated or AI-assisted output. Sessionly does not guarantee that AI-generated content will be accurate, lawful, clinically appropriate, or fit for your specific purpose.
12. Intellectual property
All intellectual property rights in Sessionly, including the software, branding, design, text, layout, features and underlying materials, belong to Sessionly or its licensors, unless otherwise stated. Subject to these Terms and payment of applicable fees, Sessionly grants you a limited, non-exclusive, non-transferable, revocable right to access and use the service for your internal business purposes. You must not copy, modify, distribute, resell, sublicense or create derivative works from Sessionly except as expressly permitted in writing or by law.
13. Customer data
You retain responsibility for the data you submit to Sessionly. You grant Sessionly the rights reasonably necessary to host, store, process, transmit, back up and otherwise handle that data for the purpose of operating and improving the service and complying with law. Sessionly may use aggregated and anonymised data for analytics, service improvement, security, and operational purposes, provided that such data does not identify you or your clients.
14. Data protection
Sessionly's handling of personal data is described in the Privacy & Cookie Policy. Where Sessionly processes customer-submitted client or practice data on behalf of a therapist, practice or agency, Sessionly acts as a processor and the customer remains responsible for ensuring a lawful basis and compliance with its own professional and legal obligations.
15. Suspension and termination
Sessionly may suspend or terminate your access immediately if:
- you breach these Terms
- payment is overdue
- continued access presents a security, legal or operational risk
- required by law
You may stop using the service and cancel in accordance with your subscription terms. Following cancellation or termination, your access may end immediately or at the end of the applicable paid period, depending on the circumstances. Data may then be deleted in line with the Privacy & Cookie Policy and operational backup cycles.
16. Disclaimers
To the fullest extent permitted by law:
- Sessionly is provided on an “as available” basis
- Sessionly does not warrant that the service will be uninterrupted, secure, error-free or suitable for every practice model or regulatory situation
- Sessionly does not guarantee that the service will meet every professional, legal, insurance, contractual or compliance requirement applicable to your practice
- Sessionly is not responsible for decisions taken by you on the basis of data, reports, reminders, automations, AI outputs, diary entries, notes, billing information or other platform content
You are responsible for using appropriate professional judgment and obtaining independent advice where needed.
17. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any rights that cannot legally be excluded.
Subject to that, and to the fullest extent permitted by law, Sessionly will not be liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, business, goodwill, anticipated savings, business interruption, or loss or corruption of data, except to the extent such exclusion is prohibited by law.
Sessionly's total aggregate liability arising out of or in connection with the service or these Terms will not exceed the total fees paid by you to Sessionly in the 12 months immediately before the event giving rise to the claim, or, if no fees were paid, £100.
18. Indemnity
If you use Sessionly in breach of these Terms, or upload or use data unlawfully, you agree to indemnify and hold harmless Sessionly against losses, liabilities, costs and expenses arising from your breach, misuse, or unlawful processing, except to the extent caused by Sessionly's own breach or negligence.
19. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. A failure or delay by Sessionly to enforce any right or provision does not waive that right or provision. You may not transfer your rights or obligations under these Terms without prior written consent. Sessionly may transfer its rights and obligations where reasonably necessary in connection with a business reorganisation, sale or transfer.
20. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
